New amendments on the Law on Employment and Work of Foreign Workers

New amendments on the Law on Employment 
and Work of Foreign Workers

A foreigner who is employed in an active company in North Macedonia for a seasonal employment and workers referred to work in North Macedonia, can be granted with temporary residence for employment. The Law on Employment and work of Foreign workers is applicable, for all foreign employees who work in North Macedonia. In general, the Law on Employment and of Foreigners, Official Gazette no. 217/2015 stipulates a quota on foreigner workers who may be engaged in North Macedonia. The quota is set by the Government based on a proposal from the Ministry of Labour in cooperation with the Employment Agency, other ministries competent for relevant fields and the Economic-Social Council.

This year Amendments to the Law on employment and work of foreign workers have been proposed. These are the first amendments to the Law on Employment and Work of foreign workers, and the proposed changes include:

  • Enabling increased mobility of foreign workers who already have employment in North Macedonia from one legal entity to another legal entity on the same or higher position when it comes to a same employer;
  • Liability of the employer is specified for the employers who failed to establish the employment, or terminated the employment contract with the foreign worker before the expiration date of the work permit;
  • The scope of short-term services is increased, those are services performed in a period up to 60 days for which a work permit is not required. These include services such as maintenance of machinery, equipment and services for job trainings, as well as services that are not able to be provided by the existing workforce in the state;
  • The registration procedure of entering and terminating the employment of a foreign worker is further specified.
