AMENDMENTS ON THE TRADE LAW

AMENDMENTS ON THE TRADE LAW

Starting from April 6th, the amendments on the Law on Trade („Official Gazette of the Republic of Macedonia“ no. 16/04… 120/18 and „ Official Gazette of the Republic of North Macedonia“ no. 77/21)shall apply to the retailer in North Macedonia. Namely, three new articles have been added, and summarized, these articles refer to the following:

  • the retailers are obliged to post a notice informing the consumers that any violation of order and discipline in front of the entrance and inside the facility will be reported to the authorities;
  • to provide a janitor or an employee in the capacity of a janitor when the number of consumers in the facility reaches maximum capacity of persons who can shop at the same time (one person on an area of ​​every 10 square meters);
  • to place appropriate signs indicating the direction of movement and keep the minimum required distance when waiting in line in front of and in the building (signs are placed at a distance of two meters: in front of each cash register and in front of the building) and
  • to provide protective equipment (masks) for the employees in the facility.

PENALTY PROVISIONS:

If the traders to whom the above changes apply, do not comply with the Law, the State Market Inspectorate may impose a fine of EUR 500 to EUR 1,000 in denar counter value for micro and small traders and a fine of EUR 1,000 to EUR 2,000 in denar counter value for medium and large traders.

Employees are obliged to wear protective equipment (masks) in the facilities where retail is performed, during the working hours. If the employees do not comply with this provision, the State Market Inspectorate may impose a fine in the amount of EUR 50 in denar counter value.
